These Terms and Conditions (the “Terms”) govern your access to and use of avldispensary.com (the “Website”) and any related services, features, content, and purchases (collectively, the “Services”) provided by Asheville Dispensary (“Asheville Dispensary,” “we,” “us,” or “our”).
By accessing the Website, creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Terms Of Use Agreement
1. Eligibility and Age Requirement
The Services are intended only for adults. You must be at least 21 years of age (or the legal age required in your jurisdiction, whichever is higher) to access the Website or purchase products.
By using the Services, you represent and warrant that you meet the age requirement and that you are legally permitted to purchase and possess hemp-derived products in your jurisdiction.
We may refuse service, cancel orders, or suspend accounts if we believe you do not meet eligibility requirements or are attempting to circumvent them.
2. Hemp Products; Compliance With Law; Customer Responsibility
We sell hemp-derived products. Laws and regulations regarding hemp-derived cannabinoids vary by jurisdiction and may change.
You are solely responsible for:
- Determining whether products are legal to purchase, possess, use, and receive in your jurisdiction; and
- Complying with all applicable local, state, and federal laws and regulations.
We reserve the right to limit, refuse, cancel, or refund any order where shipment is restricted or where we determine, in our discretion, that fulfilling the order could violate applicable law or carrier requirements.
3. No Medical Advice; Product Disclaimers
All information provided through the Services is for informational and educational purposes only and is not medical or legal advice.
Our products are not intended to diagnose, treat, cure, or prevent any disease and have not been evaluated by the U.S. Food and Drug Administration (FDA).
You should consult a qualified healthcare professional before using any hemp-derived product, particularly if you are pregnant or nursing, have a medical condition, or take prescription medications. You assume all risks associated with product selection and use.
4. Account Registration; Accuracy; Security
You may be required to create an account to use certain features. You agree to provide accurate, current, and complete information and to maintain and promptly update account details.
You are responsible for:
- Maintaining the confidentiality of your account credentials; and
- All activity that occurs under your account.
We may suspend or terminate accounts that contain inaccurate information or appear to be used for fraudulent or abusive activity.
5. Orders; Acceptance; Pricing; Availability
All orders are offers to purchase and are subject to our acceptance. We may reject, cancel, or limit any order for any reason, including suspected fraud, pricing errors, stock limitations, or legal restrictions.
Prices and promotions may change at any time without notice. We are not responsible for typographical errors, inaccurate descriptions, or pricing mistakes. If a product is listed at an incorrect price, we may cancel the order and issue a refund.
Unless otherwise stated, prices do not include applicable taxes or shipping fees, which will be shown at checkout.
6. Payment Processing
Payments are processed through third-party payment processors. We do not store full payment card numbers on our servers. Your payment information is handled according to the processor’s terms and our Privacy Policy.
You represent and warrant that you are authorized to use the payment method provided and that your payment information is accurate.
7. Shipping; Delivery; Shipping Restrictions
Shipping options, rates, and estimated delivery times are displayed at checkout. All delivery timelines are estimates only and are not guaranteed.
Certain products may be subject to shipping restrictions based on legal, regulatory, carrier, or operational requirements. If an order cannot be shipped to the address provided, we reserve the right to cancel or modify the order and will notify you accordingly.
Customers are responsible for providing complete and accurate shipping information. We are not responsible for delays, delivery failures, or misdeliveries resulting from incorrect or incomplete address details provided at checkout.

8. Risk of Loss; Seizures; Law Enforcement Interactions
All purchases are made pursuant to a shipment contract. Title and risk of loss pass to you upon delivery of the order to the carrier.
We are not responsible for:
- Items lost, delayed, or damaged in transit after transfer to the carrier;
- Packages delivered to an incorrect address due to customer error; or
- Seizure, delay, inspection, or interference by postal services, carriers, customs, or law enforcement.
You acknowledge that hemp products may be confused with marijuana by third parties or authorities, and you assume the risks associated with shipping and possession.
9. Returns; Refunds; Chargebacks
All returns and refunds are governed by our Returns & Refund Policy, which is incorporated into these Terms by reference and available on our Website.
By placing an order, you agree to contact us first to attempt to resolve any issues before initiating a chargeback with your payment provider. We reserve the right to suspend or terminate accounts associated with excessive, fraudulent, or abusive chargebacks.

10. Promotions; Coupons; Store Credit
Promotions, discounts, coupon codes, and store credit are subject to change or discontinuation at any time. Unless otherwise expressly stated:
- Coupon codes may not be used on items already marked as on sale.
- Coupon codes may not be used on accessory items.
- Coupon codes and store credit have no cash value and may not be redeemed for cash.
- Coupon codes and store credit are valid for online purchases only and may not be redeemed in-store.
- We reserve the right to limit eligibility, quantities, usage, or redemption and to cancel or refuse any promotion in cases of misuse, fraud, or error.
11. Feel Better Now Loyalty Program
Asheville Dispensary offers the Feel Better Now Loyalty Program (the “Loyalty Program”), which is powered by Alpine IQ, a third-party customer engagement and loyalty platform.
Participation in the Loyalty Program is optional and subject to these Terms, our Privacy Policy, and any additional Loyalty Program rules or disclosures provided at enrollment or made available through the Website, in-store materials, or customer communications.
By enrolling in or participating in the Loyalty Program, you acknowledge and agree that:
- Your participation is subject to Alpine IQ’s technology and systems
- Certain customer data may be processed by Alpine IQ on our behalf
- Loyalty activity, point balances, tiers, and rewards are tracked and administered through Alpine IQ
11.1 Program Overview and Tiers
The Loyalty Program is a calendar-year, tier-based program. Customers earn points on qualifying purchases and may move through four annual tiers based on spend between January 1 and December 31 (excluding taxes, shipping, fees, discounts, returns, and refunded transactions):
- Bronze ($0–$749): 1 point per $1; Birthday reward: 250 points
- Silver ($750–$1,999): 1.25 points per $1; Birthday reward: 500 points
- Gold ($2,000–$4,999): 1.5 points per $1; Birthday reward: 750 points
- Platinum ($5,000+): 2 points per $1; Birthday reward: 1,000 points
Tier upgrades apply when achieved and determine point earning rates. Once a customer qualifies for a tier, that status applies for the entire following calendar year. Spend totals reset each January 1.
All customers begin at Bronze on January 1, 2026.
11.2 Earning Points
Points may be earned through:
- Loyalty sign-up: 100 points (one time)
- Text opt-in: 100 points (one time)
- Purchases: points based on tier rate
- Birthday reward: once per year based on tier
- Refer-a-friend: points equal to 5x the points earned on the referred friend’s first qualifying purchase
Points may be adjusted or reversed for returns, refunds, cancellations, suspected fraud, errors, or abuse.
11.3 Redeeming Points
Redemption values:
- 100 points = $5 off
- 400 points = $20 off
- 1,000 points = $50 off
- 2,000 points = $100 off (Gold and Platinum only)
Points may be redeemed in-store or online at checkout, subject to restrictions. Points have no cash value, are not property, and are non-transferable.
11.4 Program Changes; Abuse; Termination
We may modify, suspend, or terminate the Loyalty Program or any aspect of it at any time, including tiers, earning rates, and redemption values, to the extent permitted by law. We may suspend or terminate accounts for suspected fraud or abuse and void points or benefits associated with prohibited conduct.
12. SMS/MMS Messaging Program (Powered by Alpine IQ)
Asheville Dispensary offers promotional and transactional SMS/MMS messaging programs (the “Messaging Program”), which are powered by Alpine IQ and its service providers.
By opting in to receive text messages from Asheville Dispensary, you expressly consent to receive recurring automated or non-automated marketing and transactional messages at the mobile number you provide.

Messages may include promotions, loyalty updates, order notifications, store announcements, and related communications.
Opt-Out and Support
You may opt out at any time by replying STOP to any message.

Data Processing and Third-Party Providers
By participating in the Messaging Program, you acknowledge that:
- Messaging services are administered through Alpine IQ and its authorized vendors
- Your phone number and messaging activity may be processed by Alpine IQ solely for program operation and compliance
- Data is handled in accordance with our Privacy Policy and Alpine IQ’s privacy and security standards
We are not responsible for delayed or undelivered messages due to carrier issues, network failures, device limitations, or circumstances beyond our control.
Number Changes and Responsibility
You agree to provide a valid mobile number and to notify us if your number changes. Failure to do so may result in messages being sent to a reassigned number, for which you agree to assume responsibility to the extent permitted by law.
13. User Content; Reviews; Submissions
If you submit reviews, comments, images, or other content (“User Content”), you grant Asheville Dispensary a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display that content in connection with our business and marketing.
You agree not to post content that is unlawful, defamatory, infringing, misleading, or contains unauthorized medical claims. We may remove or refuse User Content at any time.
14. Intellectual Property
The Services and all content on the Website (including text, graphics, product descriptions, trademarks, logos, and software) are owned by Asheville Dispensary or our licensors and are protected by intellectual property laws.
You may use the Services only for personal, non-commercial purposes. You may not copy, reproduce, distribute, or exploit any portion of the Services without our prior written consent.
15. Prohibited Uses
You agree not to:
- Use the Services for unlawful purposes;
- Misrepresent your identity or age;
- Attempt unauthorized access to systems or data;
- Interfere with Website functionality or security;
- Use automated scraping, crawling, or data mining tools without consent;
- Upload malware, viruses, or harmful code.
We may investigate suspected violations and take appropriate action, including referral to law enforcement where appropriate.
16. Third-Party Services and Links
The Services may include links to third-party sites or tools. We do not control and are not responsible for third-party content, practices, or policies. Your use of third-party services is at your own risk and subject to their terms.

18. Disclaimer of Warranties
THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Some jurisdictions do not allow certain warranty disclaimers, so some disclaimers may not apply to you.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASHEVILLE DISPENSARY AND ITS AFFILIATES, OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOSS OF DATA ARISING OUT OF OR RELATED TO THE SERVICES OR PRODUCTS.
IN ALL CASES, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER, UNLESS A DIFFERENT LIMIT IS REQUIRED BY LAW.
20. Indemnification
You agree to defend, indemnify, and hold harmless Asheville Dispensary and its affiliates, owners, directors, officers, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:
- Your use of the Services or products;
- Your violation of these Terms;
- Your violation of any law or third-party right; or
- Your User Content.
21. Force Majeure
We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, acts of government, regulatory changes, carrier disruptions, labor shortages, system outages, or other force majeure events.
22. Dispute Resolution; Mandatory Arbitration; Class Action Waiver; Jury Waiver
22.1 Informal Resolution
Before initiating arbitration, you agree to contact us at [email protected] and provide a description of the dispute. We will attempt to resolve disputes in good faith.
22.2 Mandatory Arbitration
Except where prohibited by law, any dispute arising out of or relating to the Services, products, or these Terms shall be resolved by binding arbitration, administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
The arbitrator shall apply the substantive law of North Carolina, without regard to conflict of law rules, and shall decide issues of enforceability and interpretation consistent with the Federal Arbitration Act (FAA).
Arbitration shall be conducted on an individual basis. The arbitrator may award relief only in favor of the individual party and only to the extent necessary to resolve the individual claim.
22.3 Class Action Waiver
You and Asheville Dispensary agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
22.4 Jury Trial Waiver
If a dispute proceeds in court for any reason, you and Asheville Dispensary waive any right to a trial by jury.
This Dispute Resolution section survives termination of these Terms.
23. Governing Law; Venue (If Arbitration Is Not Enforceable)
These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.
If arbitration is found unenforceable for a particular claim, you agree that any action shall be brought exclusively in the state or federal courts located in North Carolina, and you consent to personal jurisdiction and venue in those courts.
24. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you violated these Terms or engaged in unlawful or harmful conduct. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.
25. Changes to These Terms
We may update these Terms at any time by posting a revised version on the Website. The “Last Updated” date reflects the effective date. Your continued use of the Services after changes become effective constitutes acceptance.
26. Severability; Waiver; Assignment; Entire Agreement
If any provision is held unlawful or unenforceable, the remaining provisions remain in effect.
Failure to enforce any provision is not a waiver.
We may assign these Terms in connection with a merger, acquisition, or sale of assets, or otherwise by operation of law.
These Terms, together with policies referenced herein (including the Privacy Policy and Return/Refund Policy), constitute the entire agreement between you and Asheville Dispensary regarding the Services.
